Our debt recovery process
Letter before action (LBA)
When pursuing a debt recovery claim, the first step our solicitors will take will be to issue a pre-action letter. This will outline the details of the owed amount and warn that legal action may be taken if repayment does not take place.
Our debt recovery specialists will work alongside you to establish the details of your case, exactly what money is owed and by whom - using this to draft a watertight letter that sets out your position, before taking action.
An LBA will typically include details such as:
- Details and information regarding the debtors
- A concise summary and timeline of the facts
- The value of the debt being recovered
- The overdue status of the debt
- Information on any applicable interest or charges
- Copies of relevant documents such as invoices, purchase orders, or contracts
- Instructions on how and when the debtor is expected to pay
- A declaration that legal action will commence if payment is not received within 7 days
Pre-action debt recovery
There is a formal process for recovering debt in England and Wales. Court proceedings are typically viewed as a last resort and creditors are encouraged to pursue other means of recovering their debt first.
Pre-action debt recovery aims to avoid costly and lengthy court proceedings where possible, using other Alternative Dispute Resolution methods such as mediation, to come to an agreement.
If you are able to resolve matters through pre-action debt recovery, it can be a faster and more cost-effective process than court proceedings.
Debt recovery through the courts
If a pre-action letter is ignored by a debtor, or they contest its validity, it may be necessary to proceed to court in order to recover the outstanding debt.
To initiate proceedings, you will need to make an application to the court, they will then serve a claim form to the debtor, giving them two days to receive the form and 14 days to either:
- Pay the debt
- Admit the debt and offer a payment plan
- Negotiate to settle the debt
- File a defence
- File an acknowledgement of service
Court proceedings can be used to claim back the outstanding amount, as well as any interest on the original sum and compensation for late payments.
Our team can provide tailored debt recovery advice to ensure that you are properly represented at every stage of court proceedings and that you are in the best possible position to secure the right outcome.
Debt enforcement
Even after court proceedings have taken place, and the debtor has been ordered to repay the debt owed, there may be a situation where you are still waiting for a payment to be made.
While this can be particularly frustrating, you will have a number of options at your disposal. This includes:
- Third Party Debt Orders – allowing you to freeze a debtor’s funds
- A Charging Order – securing the debt against a debtor’s property
- An Attachment of Earnings Order – redirecting a debtor’s wage income to pay the debt
- A Warrant of Control – allowing bailiffs to take control of a debtor’s possessions
Depending on the nature of your case, it may also be applicable for an order to be made that instructs the debtor to provide financial information in court, or for a Financial Charging Order to enforce the sale of their property.
Our debt recovery solicitors can review your case in detail and advise you on your options, tailoring the most appropriate solution to your individual circumstances.
